15CA and 15CB are mandatory compliance forms under the Income Tax Act, 1961, required for any payment made by an Indian resident to a foreign entity. These forms ensure proper tax deduction and reporting for cross-border transactions.
Form 15CA is a declaration by the remitter, while Form 15CB is a certificate issued by a Chartered Accountant. Both forms must be filed with tax authorities before remitting funds abroad to ensure compliance with Indian tax laws and Double Taxation Avoidance Agreements (DTAA).
Filing 15CA and 15CB is compulsory before making any foreign remittance from India, subject to certain exemptions. Non-compliance attracts penalties of ₹10,000 per instance.
According to Section 195 of the Income Tax Act, 1961, any person making payment to a non-resident (including foreign company) must:
Deduct income tax at applicable rates before making payment to non-resident
Submit undertaking in Form 15CA providing payment details to non-resident
Obtain certificate in Form 15CB from Chartered Accountant for payments exceeding ₹5 lakh
Ensures tax collection on income accruing or arising in India, even when recipient is non-resident. Prevents tax evasion in cross-border transactions.
Enables Income Tax Department to monitor foreign remittances and ensure tax compliance on international transactions.
Ensures proper tax deduction at source as per Income Tax Act provisions and applicable DTAAs.
Creates legal record of foreign payments, useful during tax assessments and audits.
Ensures timely reporting of payments to non-residents and collection of due taxes.
Verifies compliance with Double Taxation Avoidance Agreements between India and foreign countries.
Prevents penalties of ₹10,000 per instance for non-filing or late filing of forms.
Form 15CB is mandatory only when remittance exceeds ₹5,00,000 during the financial year and is taxable in India.
